LEASE DEED

      This Lease Deed is made and executed on this the ____ day of _______ at ______
by and between:

(Hereinafter called and referred to jointly and severally as the TENANT of the FIRST PART which expression shall mean and include its heirs, legal representatives, administrators, successors, assignees etc.,)

(Hereinafter called and referred to jointly and severally as the LANDLORD/LANDLADY of the SECOND PART which expression shall mean and include its heirs, legal representatives, administrators, successors, assignees etc.,)


WHEREAS, the landlord/landlady herein is the absolute owner and possessor of the  _______________________________________________________________

WHEREAS, the Tenant has approached the second party to let out the above said  _______________________________________________________________ and the Second Party has agreed to let out the same on the following terms and conditions.

NOW THIS LEASE DEED WITNESETH AS FOLLOWS

1.         That the tenancy period commences with effect from ________ and the same shall be for a period of ____ years.

2.        That the rent for the demised premises has been mutually agreed at Rs. _________/- (Rupees __________________________ Only) per month.

3.         That the agreed rent shall be paid by the tenant on or before ____ day of every English Calendar month in advance to the landlord/landlady or his/her duly authorized representative regularly. The tenant shall obtain proper receipt thereof and in absence of receipt no claim for payment of rent by tenant will be entertainment.

4.         That the demised premises is let out to the tenant for ___________ purpose and the tenant shall not use the demised premises for any other purpose other than for which it is taken or rent without written consent of the landlord/landlady.  

5.         That the tenant shall not make any structures or construction in the demised premises without the prior written permission of the landlord/landlady.

6.         That the tenant shall keep demised premises in a good condition.

7.         That the tenant shall permit the landlord/landlady or his/her duly authorized agent at all reasonable time for inspect of the demised premises.

8.         That the tenant shall not be entitled to sub-let or under-let whole of part of the demised premises nor shall be entitled to induct any third person into the demised premises in any manner either by way of change in constitution of the concern or otherwise.

9.         The landlord/landlady has delivered the vacant and peaceful possession of the demised premises in good condition to the tenant who shall use and enjoy the tenancy right thereof without interference from the landlord/landlady or person claiming through them during the substances of tenancy period.  

10.       The tenant shall re-deliver the vacant peaceful physical possession of the demised premises on the date of expiry of the tenancy period agreed hereunder or on the date of termination of tenancy whichever is earlier.

11.    That non-compliance of any of the term referred to above entitled the landlord/landlady to seek the eviction of the tenant from the demised premises without any notice.  

12.       That it is further agreed that expenses of stamp duty and incidental charges for this Lease Deed has to be borne by the Tenant only.

13.       That the rent will be enhanced @ 05% on existing rent and after termination.
