Agreement of Sale Cum GPA


AGREEMENT OF SALE-CUM-GENERAL POWER OF ATTORNEY

       This Deed of Agreement of Sale-Cum-General Power of Attorney is made and executed on this the ___ day of ______ at _______ by and between:

(Hereinafter called the VENDOR)

IN FAVOUR OF

___________ S/o W/o D/o ___________ Aged about ____ years, Occupation ________ R/o H.No. ___________________________   

(Hereinafter called the PURCHASER)

The terms VENDOR and PURCHASER herein used shall wherever the context so admits mean and include their respective heirs, executors, successors, legal representatives, administrators and assignees, etc.           

WHEREAS: the Vendor is the absolute owner and peaceful possessor of ____________________________________________ Having purchased the same from ___________________________ _______________________________________________________ Hereinafter shall be referred to as the “SCHEDULED PROPERTY” which is morefully described in the schedule of property and delineated in RED COLOUR in the Plan annexed.

       AND WHEREAS: the Vendor herein offered to sell the Schedule Property and the Purchaser agreed to purchase the same for a total sale consideration of Rs. _______/- (Rupees _____________ Only) 

       WHEREAS: the Vendor also agreed to give a General Power of Attorney in favour of the Purchaser in respect of the scheduled property to act on his/her behalf and in his/her name.       

NOW THEREFORE THIS DEED OF AGREEMENT OF SALE-CUM-GENERAL POWER OF ATTORNEY WITNESSETH AS FOLLOWS

1.    It is agreed between the Vendor and the Purchaser that the Vendor agreed to sell and the Purchaser agreed to purchase the above said property for a sum of Rs. ________/- (Rupees ______________ Only) which is free from encumbrances and the said Purchaser have paid the Entire Sale Consideration of Rs. _______/- (Rupees ________________ Only) and the receipt of which the Vendor hereby admits and acknowledges, and the said Vendor have also handed the vacant possession of the said house to Vendee today.

2.    That the Purchaser shall execute regular Sale Deed in favour of the Purchaser or her nominee or nominees, and will deliver the vacant possession of the scheduled property to the said Purchaser.                                                             

3.    The Purchaser shall bear all the expenses of sale, such as stamp duty, registration  fee,  etc.,  for execution  of registered  Sale Deed and the said property will be conveyed either in whole or in parts in favour of the Purchaser or her nominee or nominees as and when required by the Purchaser.                          

4.    The Vendor have assure the Purchaser that there are no encumbrances, charges, mortgages or subsisting agreement of sale or litigations in respect of the said property in favour of any person or persons.

5.    The land is no an assigned land within the meaning of ___ Assigned Lands ( Prohibition of Transfers )Act 9 of 1977 and that the said property does not belong to and is not under mortgage to Government or their Agencies/Undertakings.

6.    The Vendor is unable to complete the sale transaction personally due to domestic pre-occupations, as such executes this Agreement of Sale Cum-General Power of Attorney in favour of the Purchaser to act in his/her name and on his/her behalf as the agent of the Vendor, and the Vendor have also handed the link documents, papers, relating to scheduled property to Vendee.  

7.    Time is not essence of this contract. And the Vendor have also handed the vacant possession of said property to Vendee today to-hold unto the same for ever as its owner  without any obstruction or hindrance either by the said Vendor or anybody else claiming the said Vendee in future period as the said Vendor have received the full and final sale amount under this document.

8.    The Vendor hereby authorize the said Purchaser/Attornies to do the following acts in his/her name and on behalf of the Vendor.   
                                               
i)     To execute the Sale Deed in favour of himself herself/ or his/her nominee or nominees and get it duly registered or to enter into Agreement of Sale in favour of third parties in respect of the said property either whole or in parts for any consideration which it deems reasonable in its absolute discretion and receive the earnest money and acknowledge the receipt of the same.         

ii)          To execute the Sale Deed or Deeds in favour of the third parties and receive the sale consideration, and to present the sale deed or deeds, executed by it in favour of third parties before the concerned registering officer, admit execution and receive sale consideration and to procure the registration of the sale deeds.

iii)   To execute, sign and file all the statements, petitions, applications and declarations, etc., necessary for the incidental to the completion of registration of the scheduled sale deed / deeds.

iv)    To complete the sale of the scheduled property and handed over the vacant possession of the said property to the Purchaser, Sub-Purchaser, etc.

v)          To appear and act in all Courts, Civil, Criminal, Revenue, whether original or appellate, in the registration and other offices of the State and Central and of Local Bodies in relating to the said property. 

vi)   To sign and verify plaints, written statements, petitions of claims and objection of all kinds and file them in such courts and offices and to appoint Advocates and other legal practitioners to file and receive back documents to deposit and withdraw money and grant receipts in relation to the said property.
      
vii)   Generally to act as the Attorney or agent of the Vendor in respect of the scheduled property in relation to the matters aforesaid and to execute and do all deeds, acts and thins to the extent of the scheduled property as fully and effectually in all respects as the Vendor or himself/herself would do if personally present.

viii)  The Vendor for herself his/her heirs, executors, successors, legal representatives, administrators, administrations and assignees hereby ratify and confirm and agree to ratify and confirm all the acts, deeds and things lawfully done by the said Attorney namely the Purchaser in pursuance of these presents.

Indemnity Bond For Electricity


INDEMNITY BOND

This Deed of Indemnity Bond executed on this ___ day of ________ at __________ by and between:

(Hereinafter called the INDEMNIFIER which term shall mean and include his/her executors, administrators, heirs, successors and assigns etc., of the ONE PART)

Whereas the consumer has taken on lease or his/her otherwise lawfully occupying the premises without a lease in H.No. ____________ in the land pro romboke in Sy. No. ______ owned by ___CPDCL for the purpose of DOMESTIC and has applied for a service connection in the above premises in my name.

Whereas the indemnifiers has requested the Board to give a service connection in his/her name subject to execution or any indemnity bond by him/her indemnifying the Board against any damage or loss caused to the board in respect of the service connection in his/her name.

And whereas in consideration of the acceptance of the above for service connection in his/her name Indemnify the Board against all proceeding claims, demands costs damages expenses which the Board may incur by reasons or a fresh connection given to the Indemnifier.

The Indemnifier further undertakes that the Board shall be at liberty to disconnect the service connection given to him/her and also or loading the dues remaining unpaid by him/her to other service connections that may stand in him/her name.

The Indemnifier further undertakes to make good and sum that may be found to be and become payable to the Board with regard to all liabilities and claims personally as well as by means of both movable and immovable properties, the Indemnifier agrees that the current consumption deposit by shall be adjusted against the arrears of current consumptions charges but also against any claims that may rise in the event of termination of the agreement prior to the expiry of the contracted period.

In view of the nature of occupation as mentioned in class-3 above the executant hereby agrees and indemnifiers the Board shall never claim to possess legal right as owner of the premises on the ground on that the Board supplied energy to the premises.

That now condition of the above written bond is made that if the indemnifier shall duly and faithfully observe and performs the above said conditions then the above written bond be void or otherwise the same shall remain in full force.

5.  That the Tenant is responsible for any misuse of Electricity by pilfer aging in Electricity Current and its Meter, and if the said electricity is disconnected due to the said reasons the Landlord/Landlady is not in obligations to provide electricity to the Tenant, and the Tenant shall be responsible for the criminal act committed by him/her.

6.    That if the Tenant fails to pay monthly rent even for a single month, it is agreed mutually that the Tenant shall be treated as a willful defaulter liable for being evicted from the premises, and the Tenant have committed willful default, and the Landlord/Landlady shall take any legal steps against the Tenant.
                       
7.  That the Tenant herein declare if he/she wants to vacate the said house taken on rent he/she will inform (03) three months advance notice to Landlord/Landlady.
  
8.  That Landlord/Landlady has let to the Tenant for Residential Purpose only and the Tenant have deposited Rs._______/­-(Rupees _____________ Only) with the Landlord/Landlady and this deposit amount shall not be adjust in rent, and shall not carries any interest. And shall be refundable at the time of vacating the said premises by deducting dues.

9.  That the Tenant herein declare if the said Landlord/Landlady wants to evict the said house given on rent he/she will inform (03) three months before to the Tenant.

10   That the Tenant will not store any explosive items or any prohibited items under the law in the said rented premises. 

11.  That after the expiry of this Rental Agreement if the Tenant wants to continue this Rental Agreement for further period on the mutual understanding of both the parties.

12. That the Tenant herein declare he/she shall keep the said premises taken on rent in neat and clean and good habitable condition as was  acquired by him/her.   
                                          
 13. That the Tenant herein declare he/she will not make any additions or alterations modification minor construction or do anything causing damage to the structure of the rented premises during the period of this Rental Agreement.

 14.   That the Tenant will not obtain any bank loans over the said House.
