Rental Agreement Absence of Owner



RENTAL AGREEMENT

          This Rental Agreement is made and executed on this the ____ day of ___________ at __________ by and between:-

(Hereinafter called the TENANT which term shall mean and include all his/her heirs, successors, legal representatives, executors, administrators and assignees etc., of the ONE PART)

 ( Hereinafter called the  LANDLORD/LANDLADY  which term shall mean and include his/her heirs, executors, successors, legal representatives, administrators, executors, and assignees etc., of the SECOND PART )

                                                                                                                                                                                                                                                                                               
WHEREAS, the Landlord/Landlady is the absolute owner and possessor of the _________________________________________
WHEREAS:  the Tenant approached the Landlord’s/Landlady’s Representative for taking the said house on rent only for a Period of ________ Months Commencing from ___________  on a monthly rent of Rs. _____ /- (Rupees _____________ Only) exclusive of Electricity and Water consumption Charges and the Landlord/Landlady herein agreed to let  out the same for the same on the following terms and conditions:-

1.    The Landlord’s/Landlady’s Representative agreed to let out to the Tenant of the above said house only for a period of ______ months.

2.    The Tenant is agreed to pay rent to Landlord’s/Landlady’s Representative  a sum of Rs.______/- (Rupees __________ Only)  towards the monthly rent payable on or before ___ day of each English Calendar month in advance and obtain valid receipt for the same from the Landlord. In the absent of a valid receipt from the Landlord no plea a discharged shall be entertained and it shall be presume that the Tenant has fail and neglected to pay the rent.

3.  That tenancy shall be for a period of ______ months the tenancy commencing from ________ and shall be for a period of only ____ Months. And after ____ months the Tenant wants to continue this Rental Agreement 05% Five Percent in monthly shall be enhance.

4.  That Tenant shall not sublet or under let the whole or any portion of the to any other sub tenant.  And the Tenant shall pay the Electricity charges and to concerned authority and shall hand over its paid receipts to Landlord/Landlady.

5.  That the Tenant is responsible for any misuse of Electricity by pilfer aging in Electricity Current and its Meter, and if the said electricity is disconnected due to the said reasons the Landlord/Landlady is not in obligations to provide electricity to the Tenant, and the Tenant shall be responsible for the criminal act committed by him/her.

6.    That if the Tenant fails to pay monthly rent even for a single month, it is agreed mutually that the Tenant shall be treated as a willful defaulter liable for being evicted from the premises, and the Tenant have committed willful default, and the Landlord/Landlady shall take any legal steps against the Tenant.
                       
7.  That the Tenant herein declare if he/she wants to vacate the said house taken on rent he/she will inform (03) three months advance notice to Landlord/Landlady.
  
8.  That Landlord/Landlady has let to the Tenant for Residential Purpose only and the Tenant have deposited Rs._______/­-(Rupees _____________ Only) with the Landlord/Landlady and this deposit amount shall not be adjust in rent, and shall not carries any interest. And shall be refundable at the time of vacating the said premises by deducting dues.

9.  That the Tenant herein declare if the said Landlord/Landlady wants to evict the said house given on rent he/she will inform (03) three months before to the Tenant.

10   That the Tenant will not store any explosive items or any prohibited items under the law in the said rented premises. 

11.  That after the expiry of this Rental Agreement if the Tenant wants to continue this Rental Agreement for further period on the mutual understanding of both the parties.

12. That the Tenant herein declare he/she shall keep the said premises taken on rent in neat and clean and good habitable condition as was  acquired by him/her.   
                                          
 13. That the Tenant herein declare he/she will not make any additions or alterations modification minor construction or do anything causing damage to the structure of the rented premises during the period of this Rental Agreement.

 14.   That the Tenant will not obtain any bank loans over the said House.

15.  That the Tenant herein declare he/she will pay Rs._____/-(Rupees _________________ Only) per month towards the water charges during the period of this rental agreement.

IN WITNESS WHEREOF, the Tenant and Landlord’s/Landlady’s Representative herein jointly executed this Rental Agreement in presence of the following witnesses on the day month, and year first above mentioned at __________.
