Rental Agreement (Shop)


RENTAL AGREEMENT

          This Rental Agreement is made and executed on this the ___ day ___________ at _____________ by and between:-

(Hereinafter called the TENANT which term shall mean and include all his/her heirs, administrators of the FIRST PART )

(Hereinafter called the LANDLORD/LANDLADY which term shall mean and include all his/her heirs, administrators of the SECOND PART)


        WHEREAS the Landlord/Landlady is the absolute owner and possessor of the__ 
____________________________________________________________________



          WHEREAS the Tenant approached to Landlord/Landlady to give on rent the said  for running _________  on a monthly rent of  Rs._______/-(Rupees ___________________Only) exclusive of electricity charges for a period of  ________ Months.

           
          AND WHEREAS the Tenant herein agreed to take the said premises on a monthly rent of exclusive of Electricity Bill, and the Landlord/Landlady herein agreed to let out the said premises on the following terms and conditions.

NOW THIS RENTAL AGREEMENT WITNESSES AS FOLLOWS:
 

1)  That the Tenancy shall commence from  _________ and shall be for a period of ________ months only.




2) The Tenant is agreed to pay the rent to Landlord/Landlady, a sum of Rs.______/- (Rupees ________________  Only) towards the monthly rent payable         on or before _____ day of each English Calendar month.

                            
3) That tenancy shall be for a period of eleven months the tenancy commences from  ______ and shall be for a period of _________ Months on the expiry of the period of this tenancy shall automatically cease unless it is renewed in writing under a valid document.




4) That Tenant shall not sublet or under let the whole or any portion of the to any other sub tenant.


5) That if the Tenant fails to pay monthly rent even for a single month, it is agreed mutually that the Tenant shall be treated as a willful defaulter liable for being evicted from the premises.



6) That the Tenant herein declare if he/she wants to vacate the said premises taken on rent he will inform (3) three months advance notice to Landlord/Landlady.


7) That the Tenant herein declare if the said Landlord/Landlady wants to evict the said premises given on rent he/she will inform (3) three month before to the Tenant.
                                                     
8)  That the Tenant shall pay the Electricity during the period of this Rental Agreement of the said rent premises and will hand over its aid       receipts to Landlord/Landlady for his/her record purpose.   


9) That the Tenant herein declares he/she will have no objection if the Landlord shall make any additions or alterations over the said premises during  period  of this Rental Agreement.


10) That the Tenant will not store any explosive items or any prohibited items under the law in the said rented premises. 


11) That the Tenant is responsible for any misuse of electricity by pilfer aging Electricity current and its Meter and if the said Electricity is          disconnected due to the said reason the Landlord/Landlady is not in obligations in          provide electricity to the Tenant, and the Tenant will be responsible for the criminal act committed by him/her.



12) That the Tenant herein declares if he/she fails to pay the monthly agreed rent         continuous for a period of two months the Landlord/Landlady shall take any legal steps against him/her and the Tenant shall have committed willful default.




13) That the Tenant will allow the Landlord/Landlady or his/her authorized person to inspect the said Shop.



14) That have deposited in cash/cheque a sum of Rs.________/-( Rupees _____________Only) with the Landlord/Landlady in cash/cheque and the Landlord/Landlady have also passed a separate receipt of it in favour of the Tenant and the said deposit amount will be refundable to the Tenant at the time of vacating the said premises and after deducting the lawful dues payments payable to the Landlord/Landlady and this deposit amount shall not be adjust in rent and shall not carries any interest.



15)  That the Tenant has specifically agreed to enhance the monthly rent at the rate of 10% (Ten percent) on expiry of every _______ months period on the existing rent by executing fresh Rental Agreement.




16)  That the Tenant herein declares the Tenant shall keep the said premises     taken on rent in neat clean and good habitable conditions as was acquired by Tenant.



 17) That the Tenant herein declares he/she will allow the Landlord/Landlady or his/her attorney to inspect the said premises during the period of this Rental Agreement.












In Witnesses Whereof  the Tenant and Landlord/Landlady herein put their           signatures on this Rental Agreement in presence of the following witnesses.
