MEMORANDUM OF GIFT

       This Memorandum of Gift is made and executed on this the ___day of  __________ at ___________ by and between:-

 (Hereinafter called the  DONOR  which term shall mean and include his/her heirs, legal representatives, successors, and assignees, etc. of the ONE  PART )  

IN FAVOUR OF 

____________ S/o W/o D/o ___________ Aged about ____ years Occupation ________ R/o H.No. ____________________________

 ( Hereinafter called the DONEE which term shall mean and include his/her heirs, legal representatives, successors, and assignees etc., of the OTHER PART)                         

WHEREAS the Donor is the absolute owner and possessor of ___________________________________________________________________________________ Having purchased the same from _______________________________________________________ ______________________ Hereinafter called the Schedule Property.

       AND WHEREAS Donor due to love and natural affection towards the Donee and the Donor herein is intending to transfer the said property to his/her ________ the Donee herein.

       AND WHEREAS the Donee herein agreed to accept the gift of the Donor_______________________________________________ ______________________________________________________.

HENCE THIS INDENTURE OF GIFT WITNESSETH AS FOLLOWS

1.    The Donor herein discharge all the scheduled property from his/her titleship, ownership and possession handed over the same to his/her _________ the Donee herein and TO HOLD UNTO THE SAME forever as its absolute owner without any obstruction or hindrance either by the said Donor or his/her heirs, claiming the said Donee now or in future period

2.    The Donor herein declare the said property hereby gifted to Donee today is free from all encumbrances, sales, gift, will, sureties, court attachments, family disputes, Govt. or Public litigations, hypothecation, bank loans, etc.

3.    The Donor herein declare that the Donee have become the absolute owner and possessor of the said property and shall make construction over the said property, and shall transfer the same to anybody of his/her choice by way of sale, gift, will, etc.                     

        

4.    The Donor herein declare that the Donee shall mutate his/her  name in any of the office or offices i.e. in Municipal Corporation of __________, Electricity and Water Works Dept., etc., on the light of this Gift Document.

5.    The Donor herein declare his/her other family members shall have got no claim, demand, right etc., in the scheduled gift property the same shall be enjoyed the said Donee as its absolute owner without any obstruction or hindrance either by the Donor or anybody else claiming the said Donee in future period.        

7.    The Donor herein declares the said Donee shall make the construction over the said gift property from his/her own funds as which the said Donor or their heirs shall have got no objection or any claim over the said gift property and the Donor will not revoke this Memorandum of Gift in future period.

8.    The Donor have got perfect and marketable title to execute this Memorandum of Gift of Scheduled Property in favor of the Donee.

9.    That the Donor herein declare his/her other family members have got no claim, interest, demand, possession etc., in the Scheduled Gift Property and if he/she do so, it shall be null and void.
