Rental Agreement for House/Flat


RENTAL AGREEMENT
             This Rental Agreement is made and executed on this the ____day of ______________ at ______________ by and between:

( Hereinafter called the TENANT which expression shall mean and include all  his/her heirs, representatives, successors  and assignees etc. of the ONE  PART)                                             
 IN FAVOUR OF
 ____________________ S/o W/o D/o  ___________________Age ___ Occupation _____________R/o. H.No. __________________________________________

 ( Hereinafter called the LANDLORD/ LANDLADY  which expression shall mean and include his/her heirs, representatives, successors, assignees of the OTHER PART)    

WHEREAS the Landlord/Landlady is the owner of_______________________

_______________________________________________ Hereinafter called the demised rented premises.   

AND WHEREAS the Tenant have approached to Landlord/Landlady to give him/her rent the said premises for residential purpose only on a monthly Rent of Rs. _________ (Rupees ________________________ Only) exclusive of Electricity charges, Water charges and Maintenance charges for a period ___________ with a renewal for further periods under the mutual understanding between the Tenant and Landlord/Landlady with a fresh terms and conditions.

   NOW THIS RENTAL AGREEMENT WITNESSETH AS UNDER
                                                        
1.         That the Tenancy had already commenced from _________ and shall be for a period of __________ Only.
                                            
2.         That the Tenant herein declares the monthly agreed rent of Rs._________/- (Rupees ___________________________ Only) is fixed for a period of ______________ is reasonable and after the period of _____________ the same shall be renewed for further periods under the mutual understanding between the Landlord/Landlady and Tenant.


 3.         That the Tenant herein declare he/she will not make any additions, alterations over the said premises during the period of this Rental Agreement.         


4.         That the Tenant herein declare he/she will not make any sub-tenant, full or part over the said premises during the period of this Rental Agreement.
 5.         That the Tenant herein declare he/she will pay the monthly rent of Rs. _________/- (Rupees ___________________________ Only) on or before ___ day of every English Calendar month to Landlord/Landlady.                                                              

6.         That the Tenant herein declare if he/she wants to evict the said premises taken on rent he/she will inform (03) three Months before to the Landlord/Landlady.                         

7.         That the Landlord/Landlady wants to vacate the said premises given on rent he/she will inform (03) three months before to the Tenant.

 8.         That the Tenant herein declare he/she shall keep the said premises taken on rent in neat and clean and good habitable condition as was acquired by him/her.                                                                                                               
9.       That the Tenant shall not store any explosive items or any prohibited items under the law in the said rented premises. 10.       That the Tenant shall not sublet or part with the said rent premises to the third party by any mode without any written permission from the landlord/Landlady.

11.       That the Tenant is responsible for any misuse of electricity by pilfer aging in Electricity current and its Meter, and if the said electricity is disconnected due to the said reason the landlord/Landlady  is not in obligations to provide electricity to the tenant, and the Tenant will be responsible for the criminal act committed by him/her.

13.       That the Tenant shall pay electricity charges, Water charges and Property Tax charges to the concerned departments during the period of this tenancy. 

14.       That the rent shall increase by 05% on the existing rent after the expiry of this Rental Agreement.

 15.  That the landlord/Landlady has already received a sum of Rs. ___________/- (Rupees ________________________Only) as Security Deposit and the said amount carries no interest and the said amount is refundable to the Tenant at the time of the eviction of this Rental Agreement.

16.       That if the Tenant cause any damage to the property, the same shall be deducted from the deposited amount.
